Notice of Privacy Practices
Effective date: November 5, 2026
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU AND YOUR CHILD MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Arise Autism Center ("Arise," "we," "us") is required by law to protect the privacy of your child's protected health information ("health information"), to give you this notice of our legal duties and privacy practices, to follow the terms of the notice currently in effect, and to notify you if a breach affects your child's unsecured health information. In this notice, "you" means the client and the parent or legal guardian who acts on the client's behalf.
How we may use and share health information without your written authorization
- Treatment. We use and share health information to provide and coordinate ABA therapy — for example, among the BCBAs, RBTs and clinical staff working with your child, or with your child's physician or other providers.
- Payment. We use and share health information to bill and get paid — for example, giving your insurance plan the information it needs to verify benefits, authorize services or pay claims.
- Health care operations. We use and share health information to run our practice and improve care — for example, quality reviews, staff training and supervision, credentialing, audits, and legal and compliance services.
- Business associates. We may share health information with companies that perform services for us (such as billing, practice-management software and IT). They must sign agreements to protect your information.
- Appointment reminders and service information. We may contact you about appointments, scheduling and services we offer.
Other uses and disclosures permitted or required by law
We may share health information when required or permitted by law, including:
- As required by law — when federal, state or local law requires it.
- Child abuse or neglect — we are required to report suspected abuse or neglect to the appropriate government authority, such as the Florida Abuse Hotline.
- Public health and safety — such as preventing disease or reporting adverse events, or to prevent or lessen a serious and imminent threat to someone's health or safety.
- Health oversight — to agencies for audits, investigations, inspections and licensure (for example, Medicaid or state licensing agencies).
- Lawsuits and legal proceedings — in response to a court or administrative order, or a subpoena under conditions the law allows.
- Law enforcement — for limited law-enforcement purposes allowed by law.
- Coroners, medical examiners and funeral directors — as allowed by law.
- Research — under conditions the law allows, such as approval by a review board with privacy protections.
- Specialized government functions — such as military, national security or protective services, as allowed by law.
- Workers' compensation — as allowed by workers' compensation laws.
- Department of Health and Human Services — to show our compliance with HIPAA.
Your choices
For the situations below, you can tell us your preferences. Let us know in person, by phone or in writing.
- Family and others involved in care. We may share relevant information with family members or others you identify as involved in your child's care or payment, unless you object.
- Disaster relief. We may share information with disaster-relief organizations to help notify family of your child's location or condition.
- If you are not able to tell us your preference (for example, in an emergency), we may share information if we believe it is in your child's best interest.
Uses that require your written authorization
We will not use or share health information for marketing purposes, sell health information, or share psychotherapy notes without your written authorization. Any other use or disclosure not described in this notice will be made only with your written authorization. You may revoke an authorization in writing at any time, except to the extent we have already acted on it.
Where Florida law gives health information more protection than federal law, we follow the stricter law.
Your rights
- Get a copy of your child's health and billing records. You can ask to see or get a paper or electronic copy. We will respond within 30 days and may charge a reasonable, cost-based fee.
- Ask us to correct records. If you believe information is incorrect or incomplete, you can ask us in writing to amend it. We may say no, but we will tell you why in writing within 60 days.
- Request confidential communications. You can ask us to contact you in a specific way (for example, a certain phone number or address). We will accommodate reasonable requests.
- Ask us to limit what we use or share. You can ask us not to use or share certain information for treatment, payment or operations. We are not required to agree, except that if you pay for a service in full out of pocket, you can ask us not to share that information with your health plan for payment or operations, and we will agree unless the law requires us to share it.
- Get a list of those we've shared information with. You can ask for an accounting of certain disclosures we made in the six years before your request. One list per year is free; we may charge a reasonable fee for additional requests within 12 months.
- Get a paper copy of this notice. You can ask for a paper copy at any time, even if you agreed to receive it electronically.
- Choose someone to act for you. A parent, legal guardian or person with medical power of attorney can exercise these rights. We will confirm the person has this authority before we act.
- File a complaint. If you believe your privacy rights have been violated, you can file a complaint with us using the contact information below, or with the U.S. Department of Health and Human Services Office for Civil Rights at 200 Independence Avenue SW, Washington, D.C. 20201, by calling 1-877-696-6775, or online at www.hhs.gov/ocr/privacy/hipaa/complaints/. We will not retaliate against you for filing a complaint.

We can change the terms of this notice, and the changes will apply to all information we have about your child. The current notice will be available at our clinics, on our website and on request.
